Where Shall I Store My Will?

Once you have decided who should benefit from your estate and you have gone to the trouble of creating a Will then you need to consider where to store it.

Many clients store their Wills at home. However, as the years pass by they may create a later Will and not store it at home. So when the time comes, the wrong Will is seen and acted upon by the executors. Furthermore, the Will might be lost, for example, during a house move. In these circumstances, if the Will cannot be found, for whatever reason, the law will presume that you have destroyed it yourself with intention, which means it has no value.

You might ask one of your executors to store the original Will. But if they lose it or you lose contact with them over time then the original might not be found when needed. Furthermore, the executor might use this Will to carry out probate when a later valid Will has been created.

Furthermore, we have a record of the Wills that our clients make over the years showing any changes that they make. When we store the Will we always know which is the latest version of our client’s Will even if the executor does not.

We strongly recommend that you choose our storage option compared to making your own arrangements. Our service includes checking the Will on receipt, scanning the original Will just before we place it into store and emailing a copy of the scanned document to our client.
