What does Estate Planning have in common with VAR?
Video Assistant Referee (VAR) was first written into the laws of association football in 2018. VAR is used to review and possibly amend a decision. Casey & Associates has been reviewing Wills and Lasting Powers of Attorney, and amending them where appropriate, for clients and prospective clients since long before 2018.
We recommend reviewing your Estate Planning every three years and here at Casey & Associates we think it is so important that we offer the service without charge or obligation. What can change in three years? Here are a few reasons why clients appreciate our review service.
- A very sad statistic is that 4.3% of people in England die between the age of 20 and 64 and so it is likely that one or both parents are alive at that time. It is often the case that an adult child is an executor and beneficiary of the Will and an attorney under a Lasting Power of Attorney.
- If one of an ageing couple is starting to lose mental capacity then Lasting Powers of Attorney are vital. But what about the distribution of the Estate? If spouses continue to “leave everything to each other” is this what is really wanted?
- If you have a guardianship clause in your Will is your proposed Guardian still an appropriate choice? Perhaps the proposed Guardian has moved abroad. Do you want your child(ren) brought up in a foreign country?
- Does your Will create a trust? Are your trustees still living in England? If not, could the trust fall under the trust laws of a country other than England?
- Does the distribution of your estate still meet your requirements? Should you leave more to your child(ren) who live closer and help out more?
- Have you thought about whether your child who has fallen on hard times (through no fault of their own) should receive more than your other child(ren)?
- Who should inherit the new business that you have recently started up?
- Do you want to protect your new house from care fees assessment in later life?
- Should you consider gifting some assets to grandchildren?
- Where is your original final Will?
- Are all your current attorneys still the best people to look after your affairs?
