What does a 'No Will' Will look like?
If you do not create a Will, this is what a "No Will" Will might look like.
- I do not revoke any previous Wills so any old Will that I created many years ago might still be valid even if it no longer reflects my wishes.
- I have not appointed executors so my family will have to go to Court and the Court will decide who becomes my administrator(s). This will slow things down.
- My children's father/mother died some years ago in an accident. I still have two children under 18 years of age. I am deliberately letting the State decide who will bring them up.
- I am leaving nothing to my partner. Everything will go to my children.
- I am married and am not leaving everything to my husband/wife. Some of our house will be owned by my children who are under 18 years of age. My husband/wife cannot move without a Court order.
- I am not creating any trusts in my Will and so, if I die before my spouse, I am not protecting any assets between my death and my spouse's death.
- I am exposing some or all of my estate to going, either wittingly or unwittingly, to my spouse's new husband or wife if I die before my spouse and they remarry later in life, therefore my children could inherit nothing.
- I am not married and could be paying £130,000 in Inheritance Tax completely unnecessarily.
- I run a business and could be leaving part of the business to my children, who are aged under 18.
