How much does it cost to create a Lasting Power of Attorney?

hero image

A Lasting Power of Attorney is an extremely important document when it comes to giving someone authority to make decisions on your behalf but how much does a Lasting Power of Attorney cost to create?

There is a compulsory cost as each document needs to be registered at a Government department, The Office of the Public Guardian. This fee currently stands at £82 per document although there are sometimes options to qualify for a reduction or exemption.

Beyond that should you choose to take advice to help you set-up a Lasting Power of Attorney (and we strongly advise that you do), there are usually fees to pay to professionals such as Casey & Associates who will compile your documents and offer advice along the way. The options for this are as follows:

DIY

You can create a Lasting Power of Attorney document yourself, but we would strongly advise against this. Although it technically can be done, a document like this takes years of experience to perfect, and you have no one to turn to if you have any questions. There is a myriad of information available on the internet on the topic, but not all of this information is correct, accurate and current and perhaps most importantly, much of it may not be appropriate to your individual circumstance. Filling this document out incorrectly could render it useless at a time when it is most needed.

Use a solicitor who will take your instructions

There are solicitors out there who will offer you the service of taking your instructions, adding these to a document and sending back to you to file accordingly. The danger with this route is that you will not often get the same level of support and advice you would get with someone like us. As this is such an important document, you could end up not taking the correct advice which could lead to disastrous consequences should this document need to be used.

Come to someone like us

Here at Casey & Associates, we are experienced at creating Lasting Power of Attorney documents for our Clients. We advise through the whole process, answer any questions that arise and are with our Clients when the paperwork is signed. This gives tremendous piece of mind as it means our Clients are safe in the knowledge that their wishes will be carried out should the document need to be used.

Crucially, dealing with us means that this document is completely bespoke to the Client and as a result of this and the detailed discussions we have, we know that their wishes are appropriate and will be met. With other options more standard templates may be used which often will not take into account an individual’s unique circumstance.

So what is the best choice?

The problem with either of the first two options is that you are too reliant on yourself to be the judge as to whether what you are doing is correct and valid and unfortunately by the time an error is noticed, it is usually too late! For such an important document we do not think this is a risk worth taking which is why it is so important to obtain professional advice from start to finish.
