Claim your Power of Attorney refund
If you applied to register a Power of Attorney in England or Wales between 1 April 2013 to 31 March 2017 you can apply to get part of your application back. This can apply to both a Lasting Power of Attorney and an Enduring Power of Attorney but you must claim your refund by 1st February 2021.
How to claim your Power of Attorney refund
Claiming your refund is straightforward, you just need to take the following steps:
- See if you are eligible – you can only claim the refund if you are either the ‘donor’ who made the Power of Attorney or the ‘Attorney’ appointed by the donor to make decisions on their behalf but the refund must be paid to the donor.
- Claim online or by phone – you can claim online by clicking here but you must have the donor’s UK bank account number and sort code. If you want to claim by phone or have to because, for example the donor does not have a UK bank account, you can do so by calling 0300 456 0300.
Once you have claimed, it can take up to 12 weeks for the claim to be processed and if the claim is approved it will be paid straight into the bank account of the donor. If your appeal is rejected you can contact the refunds helpline on the number above to appeal the decision.
If the donor has died, only the Executor of the Will, or Administrator of the Estate will be able to claim a refund. If you are making a claim on behalf of a donor who has died, you will need to send the Power of Attorney (POA) Refunds team copies of the death certificate and the Will or Grant of Representation (such as the Grant of Probate) before making a claim. You can then email this to poarefunds@justice.gov.uk, along with the following:
- your name
- contact number
- email address
- your address
- the donor’s name and case reference number (if known)
You will then get a phone call from the POA Refunds Team to complete your claim.
How much will you get?
How much you get will depend on when you paid the fees, and you will also get 0.5% interest.
