Choosing an executor is an important step when creating a Will. Executors are the people who ensure the wishes of your Will are carried out. They manage and distribute your estate after you pass away, following the terms of your Will.

Responsibilities of an Executor

  • Settling debts and expenses – This includes managing funeral expenses, paying off any outstanding debts, and administrative costs.

  • Distributing the estate – Ensuring the assets go to the intended beneficiaries according to their share.

  • Managing the estate – Valuing and gathering all the assets in the estate, including property and bank accounts.

  • Tax matters – Calculating and paying any inheritance tax due as well as settling any other taxes that may be due.


Considerations when choosing an Executor

Given the significant responsibilities of an executor, it is essential to choose someone who possesses the following qualities:

  • Organisational skills – as you can see above, being an executor can require a lot of administration and paperwork, so it is important for your executor to be well-organised and detail-oriented.

  • Trustworthy - You must trust your executor to carry out the wishes of your Will. They must act with your best interests in mind.

  • Impartiality – They must be able to act impartially and fairly, especially if there are potential conflicts among beneficiaries.

  • Financial Acumen – They should have an understanding of financial matters.

  • Age and health – It is sensible to choose someone likely to outlive you, so they can act when you pass away.

  • Location – You should consider choosing an executor who lives nearby as it makes the administration process a lot simpler.

  • Professional executor – If this all sounds like too much responsibility to burden someone with, you can appoint a professional executor to act instead of family/friends.
