Buy To Let Private Landlords

Buying property and letting it out has become very popular in recent years. Currently the Stamp Duty Land Tax “holiday” is pushing transactions and prices upwards. Estate Planners are always looking at ways to help clients and an increasing number of clients who face the Capital Gains Tax (CGT) v Inheritance Tax (IHT) dilemma have asked us if there is a solution.

As prices of your properties increase so do your CGT liabilities. You get to a point where you really do not want to pay the CGT so you hold on to your properties and enjoy the rent into old age. When you get to the point of not really needing the rental income the CGT liability is so large that you keep pushing the problem down the road. You pass away and your family / children then suffer the IHT liability.

  1. You can pass Buy To Let property to the next generation without incurring CGT however long you have owned the property
  2. The value of the property falls outside of your Inheritance Tax account after seven years
