LPAs: 4 things to consider when choosing your attorney

hero image

Your attorney is the person who makes decisions and acts on your behalf when you are unable to do so yourself. It is vital that your attorney is chosen carefully and with a lot of consideration.

We have found that the best place to start when choosing your attorney is going through the general qualities that they should have. From there, you can think through your family and friends and choose someone whose financial awareness and personality make them fit for the job of running your estates and affairs.

Here are some things to consider when choosing your attorney:

  1. They must be fair-minded

Fair mindedness is an ability a good attorney should have. You will want your loved ones and family to be treated fairly and equally. You don't want to run into a situation where someone you've appointed shows favouritism towards certain members of the family and doesn't act in your best interests.

  1. They must be trustworthy

One of the most important factors is that they're trustworthy, as they will be dealing with your finances should you lose the ability to do so. You should feel confident that your attorney will manage your finances and estates as you would wish.

  1. They must be strong and cool under pressure

You'll want to choose a attorney who is strong-minded and can handle pressure. Emotions can run high following the illness of a loved one. Some might be more concerned about what they can get from you than what they can do for you. Tensions often run high and your LPA should prepare to keep arguments and disagreements in check in regards to your affairs.

  1. They must understand you

Understanding you and your wishes in medical and family matters is crucial. Otherwise you may be caused a lot of needless distress just by thoughtless decisions.
